Emergency Board Meeting

The Board held an emergency meeting 8:30, Wednesday morning, February 1, to discuss the status of the Linda Summers lawsuit.

Linda Summers had been terminated for cause as Human Relations Director early last year because she had not been in compliance with the HR Director’s job description. She did not have an employment contract with the Association.

ICE eventually became involved as we had 40 to 56 (the number varies depending on who the Editor talks to) illegal aliens employed who promptly departed our employment. The Association conducted a self-audit correcting our documentation and hiring policies. The subsequent ICE audit resulted in no fines to the Association.

Linda Summers then sued the Association for wrongful termination. This matter eventually went to mediation which recommended settlement for $115,000, the bulk paid by our insurance carrier and the $35,973 balance by the Association.

Several board members and residents felt that this settlement was submitting to coercion and we should fight the mediator’s recommendation. The downside was the threat by Linda Summer’s attorney to continue prosecuting this case on up to the Supreme Court. Considering the possible legal costs of up to $500,000 to the Association, the settlement was the better alternative of the bad choice options. Another downside is our insurance carrier wanted to settle, and if we ignored his recommendation, the Association could find it difficult to obtain future insurance coverage.

The motion to pay $35,973 to settle the case was 7 for and 2 against.


Residents Forum

The Residents Forum will be hosting Wednesday evening, February 8 at 7:00 at Desert Vista our Security Patrol who will speak along with representatives from Metro Police on the recent increase in burglaries in Sun City. How bad has it been and what can we as a Community and as individuals do to better protect our homes.

Sun City has the lowest crime rate in the Valley because of our wonderful Security Patrol, but they need volunteers to put more patrol cars on the street. Further, we can’t just rely on them or become complacent. We all must become alert to our own actions (leaving the garage door or windows open as examples) and to what is going on in our neighborhood. There will be a Q&A and both Security Patrol and Metro will be available after the meeting to chat with you.

This presentation will be preceded by the Senior Citizens Law Project to inform residents on the assistance they provide in planning for incapacity, end of life decisions and the necessary legal documentation to ensue your wishes are followed. While their services are free, donations are accepted.
